LEVEL82 WAIVER

In return for being allowed to participate in LEVEL82 activities based out of Maryland, and all related events and programs including but not limited to academic programs, field trips, practices, games, tournaments, events and required travel for such practices, games, tournaments, events, academic programs, field trips and other activities in the United States (collectively, “Event”), I hereby forever release, waive, acquit and forever discharge and agree not to sue Players Philanthropy Fund, or Players Philanthropy Fund dba LEVEL82, or LEVEL82 (collectively, “PPF”), Torrey Smith, Chanel Smith, Torrey Smith, Inc., MSE Agency, PPF program administrators, and each of their respective representatives, employees, other person(s) or entity associated with any of the above organizations such as staff, directors, coaches, or volunteers, subcontractors, sponsors, partners, licensees, agents, affiliates, subsidiaries, parents, owners, officers, directors, shareholders and lessees of the premises (collectively “Releasees”) from all present and future claims, liabilities, obligations, damages, losses, demands, costs or expenses (collectively, “Claims”) that may be suffered by me or made by me, my family, estate, heirs, designees, or assigns for property damage, personal injury, or wrongful death arising as a result of my participation in, attendance of and/or travel to and from the in the Event and related activities. I understand and agree that the Releasees are not responsible for any injury or property damage arising out of the Event, directly or indirectly, even if caused by their ordinary negligence wherever, whenever or however the same may occur. I understand that participation in the Event involves certain risks, including but not limited to, bodily injury, loss of property, serious injury and death. I am voluntarily participating in and/or attending the Event with full knowledge and understanding of the dangers involved and I hereby agree to accept any and all risks of participation and attendance. I consent to administration of first aid and other medical treatment in the event of injury or illness. I also agree to fully indemnify and hold harmless the Releasees for any and all Claims arising out of my participation in or attendance at the Event, related activities including, but not limited to, transportation to and from the Event and the administration of any first aid and/or medical treatment. I agree that without any further consideration from the Releasees, to grant the Releasees the unlimited right and license throughout the world to use my name, nickname, image, likeness, voice, photograph, signature facsimile, and biographical information in any matter and for any purpose in any media now known or hereafter existing in perpetuity. I understand that this document is intended to be as broad and as inclusive as permitted by the laws of the state in which the Event is taking place and agree that if any portion of this Agreement is held to be invalid in a court of law, the remainder will continue in full legal force and effect. I further agree that any legal proceedings related to this waiver will take place in Baltimore, Maryland.

If agreeing on behalf of a minor participant, I certify that I am the minor’s parent or legal guardian and that I have the legal authority to agree to these terms on their behalf and agree to indemnify, save and hold harmless each and all of the parties herein referred to above as Releasees from all loss, liability, damage, cost or claim whatsoever that may be imposed upon said Releasees because of any defect in or lack of such capacity to so act and release said Releasees on behalf of the minor participant.

Should an emergency arise, as the minor’s parent or legal guardian, I hereby give my permission to the LEVEL82 staff, designated staff or coach, and/or tournament staff to call a doctor or emergency medical service and for the doctor, medical staff, hospital or medical service to provide emergency medical or surgical care for my child. It is understood that the staff will make a conscientious effort to locate the parent/guardian in the registration before any action will be taken. If it is not possible to locate the parent or legal guardian, I will accept the expense of emergency medical or surgical treatment. In the event that my child, as named herein, should require basic first aid and/or minor treatments, as ordered by LEVEL82 staff, I give permission for the health care professional to administer such aid or treatment for my child.
